Summary
It is too early to tell. However, a recent decision handed down last February by the United States Court of Appeals for the Third Circuit might indicate not an end to consumer arbitration as an out-of-court dispute settlement mechanism, but the beginning of the end of class action waiver provisions in arbitration clauses.
